1. Preamble

SchoolUpdate is a service provided by bit media education solutions GmbH (hereinafter referred to as “Provider”) and has been specially developed to improve communication between schools, teachers, parents and pupils (“Users”). The term “school” includes schools in the narrower sense as well as institutions for the education and care of children such as kindergartens, day nurseries, crèches, after-school care centres and similar institutions. In addition to teachers in the strict sense, the term “teacher” also includes educators in early childhood centres.

By registering, the user expressly accepts this Privacy Policy.

2. Privacy policy

We take the protection of personal data very seriously. We process your data as an order processor within the meaning of the General Data Protection Regulation (DSGVO) exclusively on behalf of the respective educational or care institution as the responsible party within the meaning of the DSGVO for the purpose of use defined in the Terms of Use & Licence. Any further processing or unauthorised disclosure to third parties (e.g. for advertising purposes) is excluded.

Data processing is always carried out on the basis of the applicable legal provisions (DSGVO, DSG, TKG, etc.) and technical and organisational measures are taken to ensure data security so that personal data is used properly and is not made accessible to unauthorised persons.

The employees of the Provider and its external service providers are obliged to maintain secrecy and confidentiality with regard to the data disclosed by the user in SchoolUpdate, unless there is a legally permissible reason for the transfer or disclosure

In this privacy statement we inform you about the most important aspects of the processing of personal data in connection with the SchoolUpdate system.

3. Personal data

Personal data is individual information about personal or factual circumstances of an identified or identifiable natural person.

3.1 Data provided by the user

Data actively provided by you in the course of registering with SchoolUpdate, such as when creating a new user account, will be stored and used by us solely for the purpose of providing our services to you in accordance with the intended use. This information includes your gender (title), first name and surname, email address or telephone number, and your personal username and password required to access and use SchoolUpdate.

The purpose of the processing also includes the adaptation, measurement and improvement of the Services by the Provider, the investigation and prevention of possible prohibited or illegal activities by users of the Application, and the correction of errors and problems.

3.2 Language translations

SchoolUpdate offers the possibility to translate text messages into other languages. This is done by using the commercial services of translation service providers (Google Translation API). In its privacy policy, the translation service provider undertakes to process the data solely for the purpose of providing the service and not to pass it on to third parties or store it for longer than is necessary to provide the service.

Translations of messages are not carried out automatically in SchoolUpdate, but can be initiated by the user by clicking on the Translate button. If the user does not want any personal data or other confidential information to be transmitted to the translation service provider, the user must ensure that the text to be translated does not contain any personal data or other confidential information.

3.3 Sensitive information

SchoolUpdate provides a function for recording and reporting absences due to illness, doctor’s appointment or other reasons. When recording absences, always take care not to enter and transmit sensitive personal information (diagnoses, findings, photos, etc.). There is no legal obligation to submit medical findings or documents. However, in the case of prolonged or frequent absences due to illness, written medical confirmation may be required by the educational institution.

3.4 Server log files

When you use SchoolUpdate, certain information transmitted by your web browser is automatically stored by our servers. The resulting log files contain information such as your IP address, the URL, the time, type and number of requests, the amount of data transferred, the date, time and duration of individual accesses, your browser type and other similar information.

The information stored in the log files is collected and used solely for anonymous statistical purposes (e.g. to analyse user behaviour) and to improve our services.

3.5 Cookies

The SchoolUpdate website uses cookies. Cookies are small pieces of text information that are stored on your computer. Cookies allow us to speed up navigation on our website, to adapt it to your needs and interests and to prevent misuse of the services. So-called session cookies are used, which are deleted when you close your web browser, as they only contain information that is required for one visit to the SchoolUpdate website.

You can configure your browser settings to refuse cookies. However, please note that you may not be able to use all the features of the website.

3.6 Deletion of data

The Provider will irrevocably delete the data upon termination of the contractual relationship. Alternatively, the Provider reserves the right to continue processing the usage data in anonymised form for statistical purposes after the termination of the contractual relationship in accordance with the DSGVO.

3.7 Transfer of data

The Provider does not sell, exchange or otherwise make unauthorised use of personal data or personal information. The Provider does not pass on personal data of users to third parties, unless the user has expressly consented or the Provider is obliged to do so by law or by a court of law.

3.8 State of the art

The User is aware that the current state of technology does not fully guarantee data protection when data is transmitted via the Internet. In particular, e-mails are not a secure form of communication, as it is technically impossible to prevent the contents from being read. The user is responsible for the security of the data he or she transmits via the Internet.

4. Other

You can contact bit media as provider at any time if you have any questions about the data protection provisions or if you wish to delete your profile and all data stored about you. According to the EU-DSGVO you have a right to information about your stored data and if necessary, a right to correction, blocking or deletion of these data, as far as this does not contradict the contractual obligation.

As we continue to develop our services and implement new technologies, we reserve the right to update this privacy policy at any time.
